摘要
物权法的颁布实施对我国现行城市房屋拆迁制度的影响是巨大的,首先明确了现行房屋拆迁制度实质上是强制权利人放弃权利的房屋征收,但拆迁制度却将其错误地设定为民事行为,从而导致我国房屋拆迁制度的种种弊端。第二,物权法使房屋征收补偿制度更加完善,因为征收补偿包含了对房屋和土地的全面补偿。第三,物权法解决了被征收房屋所有权转移的时间问题,即从征收决定生效时开始,从这个意义上说,钉子户的行为在物权法的框架下就是确定的违法行为。
The promulgation and execution of the Property Law has exerted great influence on the rule of urban houses' demolishing and moving. This article states: firstly, the system, de facto, is the houses' expropriation that forces the ohligee to waive their right, but the system set it as civil action wrongfully and causes a variety of problems; secondly, the Property Law can make the Houses' Expropriation and Compensation System more perfect, for the expro- priation and compensation include the whole compensation to houses and lands; thirdly, the Law settles the time problem of the expropriated transfer of houses' ownership, and then the behavior of the so - called " Nailing House Owner" will be defined illegal.
