摘要
通过对不动产善意取得制度法理基础的分析,消除对于该制度合理性的疑虑。结合《物权法》的规定详细分析不动产善意取得制度的构成要件的具体内涵及其法律后果,并对该制度适用的例外情形予以明确,以期对该制度的全面准确认识和避免司法实务中的适用错误。
This article based on the analysis of legal basis of bona fide acquisition of real estate in order to eliminate the doubt of rationality of this system.Combining the specific regulations of Property Law,this article analyzes the connotation of its constitutive requirements and its legal consequences.Then the article makes clear its exceptions of application so that we can grasp this system thoroughly and avoid the application mistakes in the real judicial practice.
