摘要
未成年人轻罪记录消灭制度作为今后司法改革的内容之一,已经被提上日程。全国各地相继推出举措,致力于未成年人犯罪记录消灭的实践探索。纵观实践探索状况,取得一定成绩,但也存在着概念表述不一、适用范围宽严不等、适用方式选择差异等问题。针对实践探索中存在的问题,以刑法的最新修订动向为导向,以未成年人利益最大化为基本原则、轻罪记录消灭为核心概念、法律后果不可撤销为基本观点,构建我国未成年人轻罪记录消灭制度是符合司法本土化要求的。
How to remove the juvenile misdemeanor records has been taken as one item on the agenda in judicial reform. Different parts of the country have put forward different measures to get involved in this issue. Looking back at the work done, we cannot deny the achievements that have been made; however, problems still exist, such as the different definition of the concept, different criteria for it, and different patterns of practice. Based on these problems in the exploration, the present paper intends to help construct the system that is appropriate for the local needs and that will take the newest revision of the criminal law as the guidance, maximize the young people＇s benefits as a basic principle, remove the misdemeanor record as a core, and will not abolish the legal consequences as the basic point.
