摘要
鉴于环境保护问题复杂性和现阶段矿山地质环境受损情况不断加深的实际情况,矿山地质环境保护在环保问题中,作为相对复杂、相对突出的问题,已然成为国家管理者亟需解决的重点问题。矿山地质环境保护与治理恢复保证金制度的建立,对保护矿山地质环境、减少地质灾害起到十分积极的作用。然而,由于对保证金性质的认识不足,实践中产生了一些困惑。本文力图从保证金民事担保及行政法意义上,对其性质进行深入论述,为实务界推进制度发展提供一定参考。
Due to the complexity of mine geological environment and continual damages, it has become a harder and more prominent issue in front of the administrators. The establishment of Deposit system plays an active role to protect the mine geological environment and reduce geological disasters. However, since the understanding of the properties of margin was insufficient, practice produced some confusion. This text tries hard to pursue a deeper analysis on the properties on the point of view of the Deposit system and administrative law, which is committed to give some advice for further development of it.
