摘要
当前,我国地方政府债券发行主体制度存在主体地位不明、权力机关功能缺位、各地政府发债权不公、主体法律障碍尚未清除等一系列问题。为进一步完善我国地方政府债券发行主体制度,应借鉴国外地方政府债券发行主体制度经验,结合我国实际,按照循序渐进原则,采取两步走战略,逐步建立实施。从近期看,要修改《预算法》,适度扩大有举债权的地方政府范围;借鉴国内外有关经验,完善发债主体的资格条件;围绕法治国家的目标,实现由政府许可向人大审议发展。从远期看,要制定《地方政府债券法》,规定各级地方政府均有举债权;进一步总结实际发行经验,制定更加科学合理的主体条件;发挥地方人大的决定性作用,实行地方政府债券发行政府备案制。
As for the issuing subject system of China＇s local government bonds,there are such problems as uncertain position for the subject,functional absence of authority,unjust power of different governments.Based on the related useful experiences from abroad and combined with China＇s backgrounds,i.e.,China＇s fiscal decentralization reform,the governments＇ functions of local public goods and public finance＇s pursuit of social equity,a scheme concerned the subject system of China＇s local government bonds has been proposed.In accordance with the principle of progression,China should adopt a two-step strategy and gradually improve the subject system of China＇s local government bonds in the scope,qualification and censor of subject.Meanwhile,the Budget Law should be modified and Local Bond Law should be formulated.
