摘要
立法语言的模糊性是必然的,其原因包括认识的局限性、语言本身的有限性、立法者的差异性以及立法技术的选择等因素。明确性的语言对于立法活动来说是一种追求和渐进实现的目标,因此,应该注重提高立法者的素质,本着简约、确定、谨慎的原则进行立法语言的选择,并通过法的解释促使立法语言从模糊走向明确。
It is inevitable for the legislation language,as the basic form of legislative activities,to be ambiguity due to limitations of understanding and language itself,the diversity among legislators as well as the choosing of their technical legislative options.The Clarity of the legislation language is a goal pursued and gradually realized by legislative activities.Therefore,strengthening the capacity building of legislators is needed so as to choose the legislation language subject to the principles of contracted,definite and modest,and make legislation language from ambiguity to clarity throught the interpretation of law.
