摘要
现行农村宅基地流转制度存在宅基地使用权不可转让性与农村住房所有权可转让性、农村宅基地物权与政府公权的矛盾。农村宅基地流转制度缺失严重制约经济结构转型。实行农村宅基地立法理念转变,制定农地分区法和进行农村集体经济组织创新是化解农村宅基地流转问题的现实选择。
Two contradictions remain in current law and policies of rural residence transfer,which exist between the transferability of rural residence ownership and un-transferability of residential land use rights,and between property rights of rural residence and its governmental ownership.Lack of effective law system of rural residence transfer restricts the transition of rural residence greatly.To resolve the problems in the law system of rural residence transfer,it is a rational choice for us to change the legislative concept about rural residence,make laws of rural land distribution,and innovate the structure of rural collective economy.
