摘要
现行农村宅基地流转制度存在着宅基地使用权不可转让性与农村住房所有权可转让性、农村宅基地物权与政府公权的矛盾。农村宅基地流转制度缺失严重制约经济结构转型。实行农村宅基地立法理念转变,制定农地分区法,进行农村集体经济组织创新是化解农村宅基地流转问题的现实选择。
In the current circulation of rural homestead servitude, there are such contradictions between the untransferability of homestead servitude and the transferability of housing ownership, and between property rights of rural homestead and government rights. The institutional deficiency severely hinders economic restructuring. A realistic choice is to transform legislation conception, conduct agricultural zoning, and innovate rural collective economic organizations.
