摘要
死亡赔偿金是对死者近亲属财产损失的赔偿。根据侵权责任法填补损失的救济功能,死亡赔偿金原则上不应适用统一赔偿标准,而应当采取以死者年龄和职业平均收入决定的差异化的赔偿标准,取消户籍因素对赔偿标准的影响,以体现侵权责任法矫正正义的法哲学思想。《中华人民共和国侵权责任法》间接体现了这一原则,未来司法解释应当做出相应完善。
The compensation for death is the compensation for the property loss of the dead＇s reletive＇s. According to the relief function of filling loss, the compensation for death should not apply to a unitary but a different standard based on the age and professional average income of the dead, and the factor of registered permanent residence shoud be canceled in the calculating standards, so as to reflect the correct justice which is the main philosophy idea of the tort liability law. As China＇s Tort Liability Law has showed it indirectly, the coming judicial interpretation should be perfected accordingly .
