摘要
利用TR IPS协议的弹性空间,以维护国家利益和促进知识产权发展的双轨思维为导向,提出建立符合我国发展现状和国际政策环境的中药专利发展战略是必然选择。针对当前中药专利发展中存在的问题,提出应当建立中药专利发展战略,完善以适当放宽专利审查标准为主的中药专利法律保护体系,建立全方位的专利保护体系。
It is an inevitable fact that we should use the selectiveness of TRIPS and work out the strategy of the growth of Chinese herbal medicine patent while defending the benefits of our country and promoting the perfection of patent area.Therefore,according to the problems existing in the Chinese herbal medicine patent,it is necessary to build up a system of legal protection which using the main idea of relaxing the restrictions of patent investigation in order to found a Omni bearing patent protective system.
