摘要
由于我国中药知识产权保护制度的不健全,人们知识产权保护意识不强,以及中药自身成分复杂的特殊性等原因,造成在中药现代化、国际化的过程中,中药配方大量外流,自主知识产权屡遭抢注的现象,给个人、集体和国家带来了巨大损失。文章对中药知识产权的现状与存在问题的进行了分析,认为可通过采用完善相关法律制度,提高产权保护意识等一系列手段,完善中药知识产权保护制度,保护产权人与民族的利益不受侵害,推动中药现代化、国际化进程。
As the intellectual property protection system of the Traditional Chinese Medicine is not perfect, people＇s awareness of IPR protection is not strong, and Traditional Chinese Medicine＇s are components complex, which result in a massive outflow of prescription of Traditional Chinese Medicine internationalization, independent intellectual property rights have been repeatedly registered which caused tremendous damage to the individual, collective and national, in the process of the modernization and internationalization of Traditional Chinese Medicine. Analysising and considering current situation and existing problems of intellectual property rights in Traditional Chinese Medicine, adopting and improving the relevant legal system, raising awareness of property rights protection, and actively promoting the Traditional Chinese Medicine industry innovation, and establishing a series of measures which fit the characteristics of Chinese medicine quality standards, we can make sure to a degree that the protection of property rights and national interests are not infringed, thus promoting the process ＆;＇the modernization and internationalization of Traditional Chinese Medicine.
