摘要
自新中国成立到改革开放之初,中国学术界关于道德权利问题的研究基本上处于空白状态。1980年代中期,道德权利问题开始受到伦理学界的关注,并逐渐成为研究和探讨的热点。在道德权利范畴能否成立或是否具有合理性,道德权利的含义、内容和特点,道德权利与道德义务、道德权利与法律权利的关系等问题上,学者们提出了各自的观点。在取得较大理论突破的同时,学术界关于道德权利的研究尚存在一定的缺陷和不足,有待于在以后的研究中加以改进和深化。
Study of the issue of moral tights was a vacuum in the Academic Circle in China from the founding of New China to the beginning of the reform and opening - up. Until the mid 1980＇s, the issue of moral fights began to receive attention from the ethical circle and increasingly became a hotspot of study and exploration. Scholars put forth their own opinions about the following questions ： Can category of moral fights be true？ Are moral tights rational？ What is the meaning of moral fights？ What are the contents and features of moral fights？ What is the relation between moral tights and moral obligation？ What is the relation between moral tights and legal fights？ Though there are great breakthroughs in the study of moral fights in theory, there are certain defects and shortcomings requiting improving later.
