摘要
人类遗传资源具有重要的研发价值,保护人类遗传资源意义重大。应当从人类遗传资源的研发特性出发制定相应的措施对其进行有效的保护。人类遗传资源不仅包括"遗传材料"本身,也包括"相关的信息资料",在保护"遗传材料"的同时应当加强对"信息资料"的保护。人类遗传资源既具有属物性,也具有属人性,应当注重和强调利用人格权法对人类遗传资源的获取和利用进行限制和保护。人类遗传资源的使用价值在研发中一次性转移,其提供者应当分享与此相应的利益。人类遗传资源为个人和遗传相关人共有,受国家的管制,国家是人类遗传资源管理和保护的主体。
Human genetic resources is of great R＆D value and it is important to protect the genetic resources of mankind. Human genetic resources should be developed under appropriate measures matching its developing characteristics. Human genetic resources include both ＂genetic material＂ and ＂relevant information＂, therefore, when ＂genetic material＂ is protected, the ＂relevant information＂ should also be considered. Human genetic resources have both physical properties and properties of human bing, in this sense, the attainment and using of human genetic resources should be restricted and regulated by law of right of personality. The use value of human genetic resources are transferred one off, so the supplier should share concerning value. Human genetic resources are shared by individual and genetic involed ones, and should be regulated by state. State is the agent of managing and protecting human genetic recources.
