摘要
随着电子商务在全球范围内的蓬勃发展,网上仲裁已经成为网络经济时代国际商事仲裁发展的必然趋势。然而,制约网上仲裁发展的除了技术方面的因素之外,更主要的是法律上的因素。从分析网上仲裁的概念及特征入手,对网上仲裁发展面临的法律问题进行探讨,进而提出完善我国网上仲裁制度的建议。
With the world-wide development of e-commerce,on-line arbitration has become the inevitable trend in the international commerce affairs of the times of network economy.However,factors that restrict the development of on-line arbitration,in addition to technical ones,are mainly legal factors.Starting with the concept and characteristics of on-line arbitration,the paper discusses legal problems faced by the on-line arbitration in its development and then puts forward some proposals for perfecting the system of on-line arbitration in China.
