摘要
在被问责官员去职方式中,行政撤职处分与引咎辞职、罢免与引咎辞职的适用情形存在适用的模糊,被问责官员复出的期限限制因去职方式不同而有差别,任命程序应该强调公开及公众参与,完善任前公示制度。
In the forms of deposition of officials for malpractice, it is vague between revoking duty by administrative agency and resigning for blame as well as between deposition and resigning for blame. In fact, with the different forms of official’s removal, the due time of official’s reappointment is different. Therefore the citizens’ participation is important in the procedure of reappointment of the officials for malpractice, so as to optimize the system of public announcement before reappointment.
