摘要
法释[2005]6号第20条对"四荒"土地之上的"一地数包"问题规定了相应的效力规则。但该规则忽略了恶意当事人的法律地位,误用了民法的占有原则,违背了不动产物权登记制度的法理。其他方式承包的土地承包经营权,在取得方式上实行的是登记要件主义,以此为出发点,可以将"一地数包"区分为承包方均已经登记、均未登记、有的登记有的未登记等几种情况,分别构建不同的法律规则。
Article 20 in Judicial Interpretation [2005] 6 set up by Supreme People's Court provides the corresponding force regulation on the problem of "one land several contracts" for "four uncultivated land". But in the regulation the legal status of malicious party is ignored, the possession principle of civil law misapplied and the legal principle of registration system for real property violated. The contracting and managing rights of land are obtained through other channels with the principle of register requirement, on whose basis, the "one land several contracts" can be further divided into such situations as registrations by all contractors, by none and by some, and the different relevant legal regulations can be constructed separately.
