摘要
解决好版权问题是机构库可持续发展的重要条件,版权法和合同法是机构库制订有效的版权政策的法律依据。文章通过对机构库相关利益方版权关系的分析,认为版权协议可以成为调整作者、作者所在单位、机构库、出版商、社会公众之间版权权利和版权义务的法律规范,它们相互之间法律关系可以通过存储许可协议、版权转让协议和知识共享协议来调整。强制开放存取政策的实施有利于机构库版权问题的解决。
With the development of digital library, in the campaign of the Open Access, the Institutional Repositories which is the new type of digital libraries arouse extensive attention. Under the Open Access envonment, through the discussion of the copyright problem of the Institutional Repositories, this article points out the frames of copyright including the law envonment and the copyright protocols in the repositories. Based on all of these, it analyzes the copyright polices of the Institutional Repositories and discuss how to avoid the copyright dissensions.
