摘要
法治的本质在于良法之治。法的价值是评价良法的主要标准。刑法的基本价值包括正义、自由和秩序。刑法的基本价值之间应当建立起价值"生态平衡"的观念,使刑法价值的三大要素在价值"生态系统"中和谐相处。人格刑法学以人格责任论和人的违法观为理论基础,将正义、自由和秩序同时纳入刑法价值体系中,是一种能够实现刑法价值观上的"生态平衡"的学说。
The essence of nomocracy is the management of good law. The value of law is the main criterion to evaluate good law. The basic value of criminal law includes justice, freedom and order. The criminal value should establish a concept of biological balance of value. Three elements of basic value of criminal law not only exist in biological system of value, in the meantime, form an matching and according relationship. The personality criminal law is an doctrine which attains the biological balance of criminal value, because it is based on the theories of responsibility of personality and person illegitimacy, takes justice, freedom and order into system of criminal value simultaneously and makes them forming an according relationship of depending and ensuring each other.
