摘要
对西方公共服务的发展起到重要作用的法律思想渊源主要有:以洛克、卢梭等为代表的古典自然法学派提出的"天赋人权"、"社会契约"理论;法国公法学家狄骥提出的公共服务理论;德国法学家福斯多夫提出的"服务行政"理论。分析了此3种公共服务法律思想渊源的主要内容及其对西方现代公共服务实践的重要影响,指出了其对我国公共服务发展的借鉴意义。
The main sources of legal thinking lic services include the following theories： playing an important the ＂natural rights＂ role in the development and ＇＂ social contract＂ of the Western pubtheory proposed by Locke／Rousseau and others as representatives of classical natural law school; the theory of public services proposed by French publicist Duguit and the ＂ Service Administration＂ theory proposed by German jurist Forsthoff. The article focuses on analysis of the main contents, the three sources of legal thinking on public services, their important influence on the practice of the modern Western public services and their enlightenment to the development of our country＇ s public services.
