摘要
加拿大化学品管理立法在结构和内容上均具有明显的特色。其立法体系完整、技术成熟,立法体例注重协调与配合,化学品管理形成了以环境部长与卫生部长牵头,特殊委员会具体执行的格局,并确立了一整套有利于化学品科学管理的基本原则,形成了一套既注重严格管理,又注重私权保护的制度体系。这对于我们改革与完善中国化学品管理的相关立法有着诸多参考与借鉴的价值。
The Canadian legislations on chemicals management show distinguishing features both in structure and content. Canada has perfect legislation system, mature legal technique in chemicals management. Its legislative model pays much attention to coordination and cooperation. The Minister of Environment and the Minister of Health play a leading role, with specific boards under them doing detailed management work, It has set up a series of basic principles which is beneficial to the scientific management of chemicals. It has build up a management system laying emphasis on strict management and taking good care of private right protection. All of them set a good example for us to reform and perfect legislations on chemical management in China.
