摘要
《鹿特丹规则》在承运人责任制度方面作出了多处变革:对运输主体进行新的细化与分类,责任基础采用完全过错推定模式,将承运人责任期间扩展至"门至门",扩展适航义务的履行期间,对运输法传统免责事项作出多处修正,进一步提高承运人的责任限额,针对承运人部分义务引入契约自由原则。上述变革进步与局限并存,其对货物运输法发展的功过评判尚需时间。
The Rotterdam Rules makes great changes in carrier's liability system taking a new approach towards the classification of carriers, adopting the doctrine of fully fault presumption as the basis of liability, extending the carrier's period of responsibility to door to door, stretching the period in carrying the duty to make ship seaworthy, modifying traditional exemption rules in transport law in many aspects, further enhancing limits of liability and, applying partially the freedom of contract principle to carriers' duties. However, merits and limitations coexist in the aforesaid changes, and the contributions or demerits it will bring to the development of the transport law will be assessed through time.
