摘要
专利侵权纠纷涉及新产品制造方法的发明专利的,制造同样产品的单位或者个人应当提供其产品制造方法不同于专利方法的证明。本文主要探讨了新产品的认定、新产品的举证责任分配及侵权判定中的举证责任分配问题。
Where a patent infringement dispute involves a patent for an invention of process for pro- ducing a new product, an entity or person producing the identical product should prove that its or his process for producing the product differs from the patented process. This article is intended to look into the issues relating to determination of new products, distribution of burden of proof with respect to new products and distribution of burden of proof in es- tablishment of patent infringement.
