摘要 在构建和谐社会的过程中,我国建立并完善多元化的纠纷解决机制已成为必然趋势。法律谈判作为一种非诉讼纠纷解决方式具有独特的价值功能。法律谈判的基本过程是沟通、协作、竞争与妥协,但必须遵循一定的价值理念以彰显其合理性与正当性。认真做好谈判前的准备工作、精心选择谈判策略和努力追求双赢结果是法律谈判必须把握的三个步骤。 In the process of constructing a harmonious society in China, it is an inevitable trend to establish and improve an integrated dispute-settling mechanism. As an alternative way or approach for settling dispute, legal negotiation has its unique values and functions. The basic processes of legal negotiation involve communication. cooperation, competition and compromise, however, during the process, in order to manifest its rationality and validity,some value concepts must be followed. And there are three steps in the process of legal negotia- tion that must be followed:doing the well--prepared work prior to negotiation.choosing the negotiation strategy with good care and endeavoring to pursue the win-win result.
