摘要
建设资源节约型社会作为一项长期的基本国策,关系着中国现代化的进程和国家安全,有利于实现人类社会的可持续发展。通过对资源节约型社会法律内涵的分析,指出了资源的范畴主要是指物质资源,核心在于自然资源。社会目的的实现,需要综合各种调整手段,法律手段是最根本的首要方式。文章通过对法律功能的理论分析,梳理了我国法制建设的现状,指出了影响法律功能实现的立法缺失,阐明了进行宏观的制度创新,需要构建静态和动态两种社会法律保障机制。以静态机制为基础,动静结合,创造良好的法治环境,充分发挥法律功能的优势,全面推进资源节约型社会建设,实现可持续发展。
The construction of resource-saving society as a long-term basic national policy is related with China＇s modernization process and the national security and is conducive to the realization of the human society＇s sustainable development. Through analysing the legal meaning of the resource-saving society, this article points out that the scope of resources mainly refers to material resources with natural resources as the core. The achievement of social objective needs a comprehensive range of adjustment methods, among which legal methods are the first and foremost way. Based on the theoretical analysis of the legal function, with the status quo of China^s legal system, the article points out the legislative deficiency that has affected the realization of legal functions and explains the macro-innovation of systems and shows that we need to build two types of static and dynamic society mechanisms for legal protection. We＇ d better base ourselves on static mechanism, combine the dynamic and static mechanisms in order to create a good legal environment and thoroughly bring the advantage of the legal function into play and comprehensively promote the construction of resource-saving society to achieve sustainable development.
