摘要
刑法规制器官移植犯罪的困境主要是观念守旧、宣传力度不够,器官移植相关立法及刑法解释工作滞后,行政刑法与刑事刑法衔接不当。应完善器官移植犯罪刑事立法,一是在刑法中增加专门的有关器官移植犯罪的规定;二是利用刑法中的已有规定处理器官移植中遇到的法律问题。
The main predicaments of defining the organ transplant crime in criminal law include that we have some old concepts, insufficient propaganda, lag relevant legislation and criminal explanation, and the administration criminal law and criminal law do not link up each other appropriately. The paper suggests that on the legislation of organ transplants crime, the regulation on organ transplants crime should be set up; and we handle problems in organ transplant cases according to the existing laws and regulations.
