摘要
高校是经法律、法规授权的一类特殊的行政主体,肩负着教育和管理的双重职能。其中,高校的教育行政管理职能在近年来越来越引起了广泛的关注,高校的管理权威也受到了越来越多的质疑,引发的诉讼呈现出逐年上升的趋势。究其原因,一个主要的因素在于目前高校内部的规章制度与立法存在一定程度的冲突,在规章制度的实施与执行方面也与司法程序存在一定的差异,最终导致纠纷的产生。高校法治化建设应与外部司法环境协调,这是高校法治化建设的基本内容,也是依法治国、构建和谐社会的重要环节。
Universities are by laws and regulations authorized by a special kind of administrative body, responsible for education and management of dual functions, of which the administrative functions of education colleges and universities in recent years increasingly attracted wide attention, the management of the authority of colleges and universities has also been an increasing number of questions arising from litigation showed a rising trend year by year.
