摘要
运用大量文献,通过法律视角对体育公共服务均等化问题进行了研究,结果表明:体育公共服务均等化属于人权事务范畴;实行体育公共服务均等化既有国际法依据,又有国内法依据;关于体育公共服务均等化的国内法存在着诸多问题:如缺乏一般法规范、程序性法律滞后以及监管不力等;为此,应该加强体育公共服务均等化的立法工作,可以采取一般发育专门法相结合形式,特别加强体育法规体系建设,确立体育公共服务均等化的法律地位,建立奖励、评估制度。
Using much documents, this thesis gave research to equalization of sports public service under the law, the results showed that equalization of sports public service belongs to category of the human rights; implementing equalization of sports public service not only from the international law, but also from the national law ; there are many problems existed in the national law, such as lacking of the common law, backward patterns ; so, we should strengthen the legisla- tion for equalization of sports public service, adopting the mode of cimbination between the common law and special law, specially strengthening the construc- tion of sport law, establishing the law position, rewarding system and appraise system.
