摘要
期待可能性理论在大陆法系的许多国家或地区的刑法理论中占有重要地位,并在刑事立法和司法实践中得以承认和采纳。一方面,鉴于期待可能性理论具有较大的生命力,而这种生命力又来源于其坚实的理论根基,我国应该积极引进这一理论;另一方面,对期待可能性理论的适用特别是作为超法规的阻却事由要持审慎的态度。
Expectation possibility theory has possessed a considerable important place in theories of criminal law in many countries and regions of continent genealogy of law and has been widely accepted and adopted in criminal legislation and judiciary practice . On the one hand, because the theory of expectation possibility is full of vitality , which comes from its strong theory base, we should introduce the theory. On the other hand, we should treat application of the theory of expected possibility prudently, specially to the hindering a mason but as surpassing law and regulation.
