摘要
农村社会保障立法的价值取向是设计我国农村社会保障制度的前提。构建社会主义和谐社会,必须确立和谐理念下农村社会保障立法的价值取向。其形成路径是通过考察我国农村社会保障立法的现状,进行问题分析,发现当前我国农村社会保障立法的价值瑕疵,从而提出基于和谐社会视阈下我国农村社会保障立法的价值取向是保障基本人权,追求社会公平,体现人本精神,促进社会和谐。
Value orientation of legislation of rural social security is the precondition of designing the rural social security system in China. Constructing a harmonious socialist society should establish the value orientation of the rural social security. Through investigating the current situation of legislation of rural social security in China, and analyzing some problems, we can find some value defects in legislation of rural social security, and then put forward the value orientation of legislation of rural social security in the perspective of harmonious society, guaranteeing the basic human rights, seeking social equality, reflecting human-oriented spirit and promoting social harmony.
