摘要
汉代是孝伦理制度化的关键时期,与褒扬孝道相对应的就是"不孝入律",对后世封建法制影响深远。由汉代各类不孝罪及对不孝罪条文和法制实效的结合、比对入手,分析汉代"不孝入律"的发展、演变过程,可探讨汉代"不孝入律"的特征以及伦理制度化、制度伦理化的历史流变。
Han Dynasty was the importance period of ethical systematization, and a celebration of filial piety corresponding to the＂not Filial joined law＂, impact to aftertime deep and farness. By the sort of non-Filial imputation in Han Dynasty, starting with the integrate, contrast of codex and actual effect of legal system, analyse the process of development and evolvement of ＂not Filial joined law＂, may discuss the characteristic of ＂not Filial joined law＇in Han Dynasty, and the historical transformation of ethical systematization and system ethicatization.
