摘要
《就业协议书》是中国特有的制度发明,虽然运行多年但目前仍未法制化,法律约束的缺失导致了"违约"现象层出不穷,纠纷甚多。这也引发了人们对《就业协议书》法律效力问题的思考。文章从高校毕业生《就业协议书》的法律性质,与劳动合同的区别以及违反《就业协议书》的法律责任进行了相应分析和探讨,明细各方权利与义务。
Employment agreement is a invention with Chinese characteristic for College Graduates. Though it has come into use for several years, it is still not being written into legel system. Lack of legal restriction, more graduates break the agreement unilateraly, and cause many disputes. It takes us to thinking about the legal effect of the employment agreement. This essay explain the legal essence of employment agreement, analysis the difference with Labour Contract, and exploration on the legal responsibility of violating the agreement, and the rights and obligations on both parts.
