摘要
随着中国足球职业化、市场化的推进,侵害职业球员利益的事件时有发生,加强对职业球员利益的保护已是当务之急。要想对职业球员进行有效保护,需要建立良好的利益表达机制和利益冲突解决机制,建立球员利益保护机制。表现在立法方面,包括两个方面的内容:在实体法方面进行合理性的制度安排,使球员的利益得以确认;在程序法方面建立有关利益冲突与争议解决的机制,保障球员利益的实现。
With the professionalization and marketization of the Chinese football, there have been violations to the professional players. In order to protect the players＇ interests, it is necessary to establish good mechanisms for interest expression and conflicts. The legislation of mechanism includes reasonable institutional arrangements on the substantive law so that the players＇ interests can be ensured. Moreover, the mechanism to settle interest conflicts and disputes on the procedure law should be set up to protect the interests of the players.
