摘要
劳动合同法从立法之初到现在,始终就存在争论,劳动合同法的价值目标应当是什么,在公平与效率之间劳动合同法应当如何权衡取舍,是争论的实质问题。劳动合同法以体现公平为最高价值目标。劳动合同法作为社会法,侧重保护劳动者权益,同时在劳动者和用人单位之间寻求利益平衡。劳动合同法增加了用工成本,对于就业也有一定影响。劳动合同法应当实现有效率的公平。
From establishment to now, arguments exist in the Law of Labor Contract. What's its value goal? The major problem is how to balance equity and efficiency. Equity shall be its highest value goal because as part of social law, the Law of Labor Contract emphasizes on rights of laborers and balances benefits between laborers and employing units. In addition, the Law increases labor wages, which affects employment. In a word, the Law shall realize efficient equity.
