摘要
知识产权犯罪研究中应当引入被害人责任概念。知识产权犯罪被害人责任大致有两种:一是滥用知识产权导致被害的责任;二是疏于被害预防而致被害的责任。知识产权被害人责任主要体现在对知识产权犯罪人刑事责任和被害人赔偿的影响等方面。
The concept of victim＇ s liability should be introduced into the field of intellectual property （IP） crimes research. Victim＇ s liability may be roughly classified into two kinds： one is caused by the right-holder＇s misuse of IP, the other is by the right-holder＇s negligence in prevention of IP infringement. Victim＇ s liability should have some impact on the criminal＇ s liability and the compensation for the victim.
