摘要
根据《劳动法》的规定,我国劳动争议采用"一调一裁两审"的解决机制,但实施十多年以来,在保护弱势群体的合法权益上,其逐渐显露出很多弊端与不足。在新的社会背景下,有必要对现行劳动争议解决机制进行深入的反思与研究,重构一个更加合理的劳动争议解决机制,更加确实地维护劳动者的合法权益。
It is universally believed that China has adopted the solution mechanism of "one-reconcilement,one-verdict and two-judgment" for labor disputes,which is also stipulated in the Labor Law. However,ten years later,the ineffectiveness and shortcomings of this Law are becoming evident in protecting the legitimate rights of social vulnerable group. Under the new social background,it is necessary to carry out in-depth reflective thinking and research on the current labor disputes settlement mechanism and restructure a more reasonable one so as to protect laborers’ legitimate rights.
