摘要
随着我国用工制度的改革,劳动争议纠纷呈上升趋势。但劳动争议仲裁程序作为人民法院受理劳动争议的前置程序存在问题,劳动争议仲裁申请时效中存在问题,劳动争议仲裁裁决向法院申请执行存在问题,在实务中经常遇到,这反映了我国劳动法律制度存在缺陷。因此,在理论上和实务上,研究上述问题就具有重大的意义。
With the reform of our labor system,labor disputes are in a rising tendency.But we often face the fact in practice:there are potential problems in the arbitration procedure of labor disputes in former procedure of accepting and hearing labor disputes by the People's Court;the potential problems in the application effectiveness of labor disput-ing arbitration;the potential problems in applying execution to the court.This shows there are defects in our labor law system.Therefore,there exists a great significance in the study on the above topics in theory and practice.
