摘要
采用问卷调查、实地考察等研究方法,对我国职业体育产业政府规制的现状进行剖析。认为:我国现行职业体育产业政府规制体制是一种典型的分权规制模式;规制机构设置不合理,职能不清,目标模糊;立法公开性不够,尚未形成完善的规制法律、法规体系;规制能力不足,规制质量不佳;规制过度与规制不足、越位、缺位并存;规制机构的规制行为缺乏相应的制约机制;俱乐部尤其是消费者利益集团尚未成熟。据此提出建议。
The methods of questionnaire, on-the-spot investigation etc. were applied to analyzing the status quo of governmental regulation to professional sports industry in our country. It believed that the existing system of governmental regulations to professional sports industry in our country was a typical power-dividing regulation model; the set-up of regulative institutions was unreasonable, their function and target were obscure, the overt extent of legislation wasn＇t enough, the legal and statutory system of regulation was imperfect, regulatory capability was defect, regulatory quality wasn＇t high, the excess of regulation coexisted with the defect, offside and vacant of regulation, the regulatory behavior of regulatory institutions was lack of relevant restriction and clubs, especially beneficial groups of consumers weren＇t mature. Accordingly it put forward some suggestions.
