摘要
我国农村承包土地调整的变化已超出了法律的预期,重新解析农地调整的价值基础和调整因素,有利于构建更合乎农民需求的土地调整制度。农村承包土地的调整在法律逻辑层面与治理逻辑层面有很大的不同,政策、立法层面的法律实践与农村实际有一定的差距,而治理层面上,用经验材料从另一方面分析法律调整制度,以及村庄自身治理对法律实践的影响,才能用村庄本身的内部逻辑体现出调整根源。在调整问题上的形式和主体性同样有极大的区别,同样是支持土地调整的地方性规范,规范的性质其实并不相同,其背后的地方性共识的基础也不相同。让土地调整的法律逻辑遵从治理的逻辑,探寻治理的本质,才不至于让法律淹没于治理的逻辑之中。
The change of Chinese rural contracting land’s adjustment is now beyond the expection of the law.Re-analysising the basis of the value and the factor of the rural land adjustment helps to construct the land adjustment system which meets the farmers’ needs.The rural contracting land’s adjustment in the legal logic level differs from that in the governance logic level.The gap still exists between the legal practice of the political and legal level and the rural reality.However,in the governance logic level,by using the experience materials,to analysis the legal adjustment system and the results that the village’s self-management influent the legal practice from another side,which presents the root of the adjustment using the inner logic of the village.Meanwhile,the difference exists in the form and the subjectivity of the adjustment.Being the local regulations that supports the land adjustment,actually,their nature and the basis of the local consensus are dissimilar.We should make the legal logic of the land adjustment comply with the governance logic,search for the nature of the governance,which won’t submerged in the logic of governance.
