摘要
为了适应市场经济的充分发展并满足企业融资的需求,避免传统抵押权模式对效率价值的旁落,我国《物权法》借鉴发达国家担保物权立法经验创设了一种新的担保方式——动产浮动抵押制度。与固定抵押相比较,动产浮动抵押制度的界限显然较为模糊,实务操作中变数较大。因此,对于动产浮动抵押制度实施中所存在的问题我们应该有清醒的认识,并采取相应的对策来防范该制度所附带的风险,力争发挥其积极作用。
To be seasoned with the sufficient development of the market economy,satisfying the finance requirement of enterprises and avoiding traditional mortgage mode ignoring efficiency value.Our country's real right law creates a new form of security by using the security property legislation experience from developed country for reference—— the movable property floating mortgage system.Comparing to immovable mortgage,the ambit of the Movable property floating mortgage system is darker,and lead to quite variable in practice.So,we should have level-headed cognition to the problems of the movable property floating mortgage system putting in practice and take relevant countermeasures to keep away the risk which is incidental by the system,and strive to bring its active function into play.
