摘要
我国目前实行的是主要以排污总量控制为目的的排污许可证制度,既缺乏立法的规范与支撑,又与其他制度之间存有冲突之处,未能满足加强污染物排放控制的需要,其实施效果不尽如人意,加强排污许可证立法,完善污染物排放控制具有十分重要的意义。尽快制定排污许可证条例,就排污许可事项做出全面规定,以保证排污许可证制度的依法施行。
The system of pollutant discharge permit in China aims at total quantity control of pollutant discharge, which neither lacks of legislation regulation nor exists conflict with other systems. And what’s more, such system fails to meet the needs of controlling pollutant discharge and its actual effect is not so satisfactory. Thus, it is of important significance for China to strengthen the legislation of pollutant discharge permit and perfect the control of pollutant discharge. It is urgent to set up the regulations on pollutant permit to regulate the issues on pollutant discharge and to guarantee the implement of the system of pollutant discharge.
