学生诉讼权宪法保障问题思考——以美国斯坦福大学《学生司法宪章》为例

摘要 斯坦福大学《学生司法宪章》在校园司法工作中,一方面始终将受指控学生的诉讼权利保护置于首位,另一方面又充分尊重了学生的诉讼参与权。《学生司法宪章》不仅为受指控学生制定了十方面共二十二项诉讼权利,也为司法过程中的其他诉讼参加人规定了七个方面共十四项诉讼权利,而且这些权利设定都以美国宪法《权利法案》为基础,通过这些逻辑严密的诉讼程序充分保障了学生的诉讼权利,也体现了权利平等、正当程序、人民主权的宪政思想。 The "student judicial Charter" of Stanford University in the administration of justice on campus, on the one hand, always regards the protection of the accused student's litigation right as foremost, on the other hand, respects fully the htigation participation right of students. The Chater is not only for the accused students to develop a total of 22 rights of litigation in 10 aspects, but also for other participants in the process of judicial proceedings to provide a total of 14 lawsuits rights in 7 aspects. Moreover, these rights are set on the basis of "Bill of Rights" in the United States Constitution, and through the rigorous logic of these proceedings they fully protect the students'htigation rights, also demonstrate the right equality, due process, and the constitutional thinking of the people's sovereignty.
