摘要
法治、宪政的精神和理念就是控制国家权力、保障公民基本权利。在诉讼调解中,为保障当事人的处分权得到自由行使,其核心就是控制司法权的过度介入。在中国这种权力崇拜的传统文化中,控制司法权力是实现诉讼调解创造性转化的关键。
The spirit and idea of the rule of law and constitutional government are to control the state power and to guarantee the basic rights of citizens. In the lawsuit mediation, the core for guaranteeing the parties to freely exer else their right of disposition is to control the over-interference of juridical power. Under the background of tradition of power worship, to control the juridical power is the key to realize the creative transformation of lawsuit mediation.
