摘要
科技发展催生出知识产权法律制度,知识产权法律制度也应随之发展。基于我国科技发展和知识产权法律保护现状的研究,认为应当设置与科技发展相适应的新的具体权利,从而赋予知识创造者更多的权利和保护,扩大保护对象的范围,切实落实"有法可依"的法治理念;还应当提高知识产权领域的立法技术,借鉴其他先进国家较为先进和详密的法律理念和法律理论。
As we all know, science and technology can hasten the development of intellectual property legal system. With the continuous progress of science and technology, intellectual property fights for its services should also be followed legal system development. The author, based on China＇ s scientific and technological de- velopment and intellectual property fights, thinks that specific fights should be set up with the technological de- velopment, create more knowledge to the fights and protection, expand the scope of the protection of objects, and effectively enforce law, enhance intellectual property fights legislation in the field of technology.
