摘要
新闻监督权的本质属性是属于人权范畴之表达自由,其制度形态经历了"习惯下的自由"、"法制下的自由"、"法制权利"到"宪法权利"。我国的新闻监督权还处于"法制下的自由"状态。新闻监督权应该入宪,以使得其由"法制下的自由"成为"法治的权利"。
The nature of the media＇s right of supervision belongs to the freedom of expression in context of human rights, morphology of which in system has experienced the ＂freedom in habits,＂ ＂freedom under the rule by law＂ and ＂legal right＂ to the ＂constitutional rights＂. In China, the press supervisory right is still in the state of ＂the freedom under the rule by law＂. News supervisory authority should be written into the constitution in order to make it from ＂freedom under the rule by law＂ has become ＂the rights of the rule of law＂.
