摘要
贸易自由化作为经济全球化的主流,对环境的影响日益显著。WTO对环境保护和可持续发展给予很大关注,有关环境保护政策与措施规定诸多,并有其特点。但WTO贸易与环境政策面临不少冲突。在环境保护和国际贸易的协调中,WTO应该坚持可持续发展的目标,在促进国际贸易自由化的进程中强化环境保护;加强WTO规则与多边环境保护协定的协调,努力实现贸易与环境立法的趋同化;坚持"共同但有区别的责任"原则,加强发达国家与发展中国家之间的合作;发挥争端解决机制的积极作用,重视DSB对贸易与环境规则的解释。
As the main trend of economic globalization,the liberalization of trade has an increasingly great impact on the environment. Out of its enormous concern with environmental protection and sustainable development, the WTO has adopted a considerable number of unique policies and measures in this regard, but the WTO trade and environmental policies have encountered many clashes. The WTO must adhere to the target of sustainable development in its coordination between environmental protection and international trade, and lay emphasis on environmental protection in its promotion of free trade. The WTO must strengthen coordination between its rules and the multilateral agreement on environmental protection so as to bring trade policies in line with environmental laws. Cooperation between the developed nations and the developing nations should be expanded on the basis of ＂shared but differentiated responsibilities＂. Efforts should be made to give full play to the dispute settlement mechanism with due respect to the DSB interpretation of the trade and environmental rules.
