摘要
民事法律行为是民法学的基本概念和制度。民事法律行为以意思表示为核心,以设立、变更或终止民事法律关系为目的,按照当事人的自由意志而产生法律效力,是实现私法自治的工具。意思表示作为民事法律行为的核心和基本要素,在法律行为制度中占有举足轻重的地位。意思表示必然成为绝大多数法律关系的起点,尤其是私法关系中的合同关系。
The civil juristic act is the basic concept and system of civil law. The purpose of the civil juristic are setting up, changing or finishing the civil juristic relation. It means the declaration of will, because it result the legal effect according to the pro＇ties＂ free volition. So the civil juristic act work as the tool of judicial self-restraint. As the core and basic concept of the civil juristic act, the declaration of will has a very important status in legal act system.
