摘要
汉朝政府为了加强社会治安管理,曾颁布一条禁令,即"三人已上无故群饮酒,罚金四两。"在汉代此禁酒令应有其固定的司法解释。另从其具体司法实践来看,效果并不显著。造成这种情况有许多社会原因,然而尽管这条禁令虽基本为具文,但我们仍不能否认其在汉代社会治安中所起到的应有作用。
Han dynasty in order to strengthen the management of the social public security, proclaimed a decree that masses couldnt drink wine together without reason . At the level of judicial institution, the drinking ban has specific judicial explanation in Han dynasty, At the level of judicial practice, facts show that this ban hasnt been carried out really in the progress＇s of the management of the social public security because of many social reasons, However, although the ban was unpracticed regulate in definite terms. We couldnt deny its function in the social public security.
