摘要
法美学在现代人文理性的基础上提供了一种可能的法律生活,它集中体现了科技理性与伦理理性的统一,合规律性与合目的性的统一,理性和非理性的统一,生产方式与人性的统一,目的在于把人的法律世界还给人本身,使人在法中能够诗意地栖居,使法能够成为人们的精神家园。但是,现代人生存的困境却直接动摇了现代法律存在的根基,"现代性危机"直接导致了法律的"总体性危机"。科学理性造成了法律的科学化倾向,伦理理性造成了法律的伦理化倾向,后现代的非理性更是造成了法律的非法律化倾向。传统的"上帝中心论"、"人类中心论"、"生态中心论"法学范式无力解决现代法律的"总体性危机",也无力引领法学步入更高的境界。这就迫切需要我们立足中国特色社会主义伟大实践,在科学发展观的指导下进行重大法学理论创新,通过构建以人为本、体现人文关怀的法美学,为中国现代社会提供法理依据,为现代人提供一种可能的审美的法律生活。
On the basis of human reason in the contemporary world, legal aesthetics ensures an alternative legal life, representing a unity of scientific reasoning and ethic reasoning, of conformity to laws and conformity to objectives, of rationalism and irrationalism, and of mode of production and human nature, for the purpose of returning man's world of law to man himself so that he can dwell in it with poetic sentiment as if it were his spiritual home. Nowadays, as a result of man's predicament, the foundation of the law has been undermined, and various traditional theories have proved ineffective in overcoming the crisis of the law. Such a situation calls for the construction of man-centered legal aesthetics to offer an alternative legal life to modern people.
