摘要
当前,"宽严相济"政策在刑事司法领域已得到广泛运用,公安执法人员在打击刑事犯罪的过程中也已基本树立起该理念,然而,"宽严相济"政策在公安机关的治安管理处罚工作中却鲜有提及。从性质、内容、形式和功能等方面来看,将"宽严相济"引入公安机关的治安管理处罚工作是可行的和必要的,这有助于公安执法人员转变执法观念,提高执法能力,实现治安管理处罚工作的最佳执法效果。
The criminal policy of tempering justice with mercy has been widely used in the filed of criminal judicatory administration and the law enforcement officials have set up that concept already in cracking down on crimes. However, the policy of tempering justice with mercy is rarely mentioned in the public security work of security administration punishment. It＇s feasible and necessary for the public security organs to introduce the rule of tempering justice with mercy into the work of security administration punishment from the point of view of its nature, content, pattern and function. And it will help the law enforcement officials of public security organs change their ideas of law enforcement, enhance their abilities of enforcing the law and realize the best effect of security administration punishment.
