摘要
市民宪法坚持"宪法从人民生活中来,到人民生活中去"的理念,与传统政治宪法比较而言,具有独特的品格。一是生活的品格:宪法基本权利的保障范围应与人们的生活范围重合,人们可以运用宪法知识解决生活中的许多问题;二是精细的品格:宪法应该是一个"有效且无漏洞"的规范体系,关注人们生活中琐碎、具体的事件;三是制度的品格:任何权利均具有"制度保障"的品格,立法机关的"形成自由"不得侵害特定法律制度的核心与本质内容,在履行宪法的保护义务时遵循"不足之禁止"与"过度之禁止"两项基本原则;四是技术的品格:宪法条文的内容要通过特定的技术手段进行发掘,宪法问题要借助切实可行的具体方案进行解决。
Compared with traditionally political constitution, the civil constitution, which insists on the idea of ＂Constitution comes from people＇ s life, and goes back to people＇s life＂, has unique characters. One is the characters of life： the security coverage of Constitution＇s basic rights should overlap with the scope of people＇s living; People can apply Constitution to solve their problems in daily life. The second is the refined characters： Constitution should be a standard system of effectiveness and invulnerability, focusing on people＇s trivial and specific events in life. The third is the institutional characters： any right has the characters of institutional security; The setting freedom of legislature must not violate the core and essential content of specific legal system, and follows the two basic principles of ＂deficit prohibition＂ and ＂excessive prohibition＂ when Constitution undertakes the protective obligation. The fourth is the technical characters： the provisions in Constitution should be exploited through the specific technology medium; The problem of Constitution should be solved by feasible and concrete schemes.
